The Law Society of Kenya (LSK) has faulted Senate Speaker Ekwe Ethuro for accusing the Judiciary of undermining the House by issuing court orders against decisions it makes in line with devolution.
Speaking after chairing the LSK Special General Meeting, Chairman Eric Mutua insisted that the High Court had the mandate to interpret the law on it discretion without coercion.
Mutua added that those who feel aggrieved should follow due process by appealing at the Court of Appeal and Supreme Court.
Ethuro had yesterday hit out at the Judiciary for what he termed as an attempt to usurp powers of the Senate and impede the legislature from carrying out its oversight mandate.
Some of the Judiciary’s controversial rulings, which have seen the two institutions clash include the reinstating of Embu Governor Martin Wambora after he was impeached by the Senate and recently the High Court issued an order barring governors from appearing before Senate Committee and respond to audit queries over how funds allocated to counties were spent.

Yesterday, Mutua warned that the country is likely to be plunged into anarchy as the rule of law is constantly threatened by the Legislature and Executive, which wants to muzzle the judiciary.
