A doctor was Wednesday charged in a Nairobi court with obtaining goods by false pretence.

Joel Mutisya who runs a clinic at Westlands, Nairobi, denied defrauding George Mathari Kiarie of Sh92,402 before Senior Principal Magistrate Lucy Mbugua.

The court heard that on October 3, at Highridge in Westlands, Mutisya with the intention to defraud, obtained goods worth Sh92,402 from Mathari of Page Signs and Graphics Company.

He is alleged to have obtained nine door signs, one roll burner and one snapper from the said Kiarie.

Mutisya was also charged with obtaining meals amounting to Sh101,085 on diverse dates between October 22 and 29, at Avanti restaurant group in Westlands.

The accused pretended to be in a position to pay for the meals, a fact he knew to be false.

He was further charged that on dates between October 8 and 22, in Westlands, the accused obtained 40 reams of art paper size A4 valued at Sh414,000 from Samwel Kariuki of Jodari Gas and Petroleum Limited.

The accused was arrested on Monday and has been in custody since then. He told the court that his rights and fundamental freedom had been violated as he was not arraigned in court within 24 hours as required by law.

Ms Mbugua referred his application to the trial court where Magistrate E C Cherono said the accused’s application will be scheduled for hearing.

He added that the prosecution was accordingly notified.
