Nakuru, Kenya: The county government has won the first round in a case filed by three matatu saccos challenging their ejection from a bus terminus during clean up of the town in December last year.
Nakuru High Court Judge Janet Mulwa yesterday vacated status quo orders issued on January 23 after the lawyer of the saccos Steve Kabita sought for more time to file supplementary affidavits.
Kabita representing Kanu Street Travelers, Free Area Travelers and Phase II Travelers Saccos, sought adjournment on grounds that the petitioners had not given instructions on how to proceed on the case.
Compelling reasons
However, lawyer Wilfred Konosi representing county asked the court to vacate orders issued saying the saccos had not given compelling reasons why they had not filed affidavits.

The complainants were moved from Nakuru Municipality block 10/26 to Kirumbux road.
County secretary Joseph Motari in response to the petition told the court that the saccos had not proved the land was set aside for Matatu terminus and added that the saccos had been given alternative space to run their operations.
"The orders for status quo granted by court on the January 21 are discharged," Judge Mulwa ruled.
