Kenya: A city debt collector has moved to court seeking to be joined in a suit challenging an attempt by Parliament to remove six members of the Judicial Service Commission (JSC).
In an application filed in court Tuesday, Mr Bryan Yongo has protested against the orders issued by the High Court, which suspended proceedings by Parliament to initiate the removal JSC members.
Yongo submits that he had personally appeared before Parliament’s Departmental Committee on Justice and Legal Affairs on October 24 and demonstrated genuine grounds for the removal of one of JSC members, lawyer Ahmednassir Abdullahi.
Pupilage certificate
The businessman claimed he had been adversely affected by the sanctions imposed on the committee that had recommended last Friday that six members of the JSC be replaced.
Yongo has also filed another suit in court seeking to have the name of lawyer Ahmednasir removed from the Roll of Advocates and the JSC on the basis that he never received the mandatory pupilage certificate from his master, the late lawyer Peter Simani.
However, lawyer Paul Muite representing the JSC objected to Yongo’s being joined in the suit and urged Justice George Odunga to strike out his application. Last week, the High Court stopped Parliament from going ahead with proceedings for the removal of the commissioners.
Justice Odunga issued conservatory orders halting the parliamentary committee from continuing with the process .The judge will rule on Yongo’s application Wednesday morning.
