NAIROBI, KENYA: The Judicial Service Commission (JSC) and Judiciary Chief Registrar Gladys Shollei are engaged in discussions to resolve the row through arbitration out of court.

Lawyer Paul Muite representing the JSC told High Court judge David Majanja that all the parties in the suit had opened discussions seeking to resolving the matter and sought two days to conclude the talks.

“The parties in the suit are engaged discussions with a view of resolving the matter. We are seeking the court to grant us two days so that we can appear in court on Friday and I believe by then we would have reached a consensus,” said Muite.

The lawyers of the parties are expected to hold discussions over the intended commencement of the disciplinary proceedings and the suit filed by Shollei on Tuesday and Thursday and report back to court on Friday.

Shollei has named JSC, its three commissioners, Ahmednasir Abdullahi, judge Mohammed Warsame and chief magistrate Emily Ominde as respondents.

However Lawyer Donald Kipkorir representing Shollei told the court that the most saddening aspect was that his client was not aware of the charges that the commission had preferred against her.

“My client has not been charged with anything. The allegations leveled against her were made while she was out of the country and she is not aware of any charges,” Kipkorir told the court.

The counsel submitted that the JSC was trying to prosecute the registrar through the media by peddling allegations that she was not aware of.
