The Musalia Mudavadi-led party in its case filed yesterday, accused ODM of breaching their pact on positions by kicking out Kakamega Senator Cleophas Malala as Senate Deputy Minority Leader. Kilifi Senator Stewart Madzayo replaced Malala.
The battle between the two now lifts the lid on the agreement between National Super Alliance principals Raila, Mudavadi, Wiper Leader Kalonzo Musyoka and Ford-Kenya boss Moses Wetang’ula.

“It was never envisaged under the coalition and power sharing agreement that a constituent party would abuse its numerical strength in both Houses to bully and dictate who holds leadership positions in the National Assembly and Senate,” the papers filed by JSG Law LLP says further. Malala claims that he was condemned unheard, and that his removal was illegal.
They now want the court to bar Madzayo from taking over the position until the case is heard and determined.
“There has been no internal process within the coalition initiated by either the respondent or any partner thereof on my removal from the office of the Deputy Minority Leader in Senate,” Malala claimed in his supporting affidavit.
