The Director of Public Prosecutions (DPP) Keriako Tobiko has approved proposed criminal charges against Lamu West MP Julius Ndegwa.

Ndegwa is accused of irregularly withdrawing Sh1.6 million from the Constituency Development Fund (CDF) kitty for construction of a cattle dip.

The DPP approved recommendations by the Ethics and Anti-Corruption Commission (EACC) to charge Ndegwa, CDF Accounts Manager Michael Kamau and the CDF project management committee.

The DPP also accepted recommendations to close files of former Kenya Airports Authority Managing Director Stephene Gichuki and staff John Thumbi, Philemon Chamwada and Allan Muturi for lack of evidence with no further action.

The commission was investigating claims of abuse of office and failure by KAA management to comply with provisions of Public Procurement and Disposal Act, 2005 and Regulations in the procurement of the proposed Greenfield Terminal Project.

Tobiko said in a statement he had agreed with the recommendations by EACC that six officials of Trans Nzoia County be charged with criminal offences over irregular awarding of tender for the renovation of Kenyatta Stadium in Kitale to West End Company.

He said Embu County Secretary Margaret Kariuki and five others will be charged with various criminal offences over claims that they awarded contracts for rehabilitation of the local stadium without following procurement procedures.

"I wish to emphasise that the suspects directed to be prosecuted are and each of them is presumed innocent and entitled to a fair trial. As such, it would be inappropriate for me to comment on the matters further," he said.

The cases are part of those that were in the list of shame presented to Parliament more than two months ago.
