A lawyer jailed for one year by a Voi court for obtaining Sh2 million by false pretence has moved to the High court to appeal the sentence.
Dickson Oruko Nyawinda, serving his sentence at Voi Prison, now wants his conviction and sentence to be quashed on grounds that the magistrate who jailed him failed to take into account his prosecution was not sanctioned by the Director of Public Prosecution as provided by the law.
Nyawinda argues that the evidence against him was not corroborated.
He claimed that some of the witnesses called during his trial were couched by his accuser saying there was no truth in what was adduced in the court.

Yesterday his lawyer Jared Magolo said in the Mombasa High Court that his client was not a businessman who sells maize as claimed by his accusers when he was indicted and charged.
Nyawinda denied claims he received Sh3.2 million to buy 500 bags of maize which he was to pay immediately after selling them.
