The management of Uchumi Supermarket has denied that it fired its former CEO Jonathan Ciano.
Mr Ciano has moved to court claiming that he was unfairly sacked by the management board of Uchumi Supermarket.
The supermarket chain says Mr Ciano left out of his own volition and was not kicked out.
According to the retailer, the former CEO handed in his resignation letter on January 13, 2015.
"There is no proper claim before the Employment and Labour Relations Court, in which the board of directors is being asked to compensate him," said Uchumi lawyer Patrick Lutta.
The court heard that there were negligence and breach of contract concerns surrounding Ciano’s reign at Uchumi.
Uchumi claims that the former CEO did not inform the management that he had conflict of interest in ventures and contracts with the firm.
Also at the centre of the war between Ciano and his former employer is Sh49 million which the former CEO is squabbling over with the board.
The board says it was not informed of a rights issue or a memorandum published in November 2014.
During the hearing, claims that Ciano was forced to resign as the chairperson of Institute of Certified Public Accountants Kenya disciplinary committee surfaced.
The case will be mentioned on February 16.
