A court has temporarily stopped Vihiga County Government from tendering for construction of 77 roads after a petitioner claimed the shortlisting of contractors was flawed.
The petitioner moved to court saying some bidders were given preferential treatment.
In his court papers, Patrick Imbatu said although the law requires 30 per cent of the tenders to be allocated to Persons Living with Disabilities (PLWD) and 20 per cent to locals, the county government has failed to publish a list to confirm this.
Without the list, he said, it is hard to ascertain if the pre-qualification requirements were met before the award of the tenders.
Mr Imbatu claimed some contractors were given adequate time to present their quotations while others were given just 48 hours to do so.

Imbatu, a businessman and a resident of the county, has sued the departments of Treasury, county executive and the county government.
He enumerated 77 roads earmarked for construction or maintenance alongside 20 bridges
Under a certificate of urgency, the petitioner said the process was designed to favour a certain class of contractors.
Vihiga Senior Resident Magistrate WK Cheruiyot certified the matter urgent and barred the respondents from proceeding with tendering and payment.
