Release Miguna by 2pm, High Court orders Inspector General and DCI

High Court judge Luka Kimaru has sent an order to Inspector General of police Joseph Boinnet and the Directorate of Criminal Investigations (DCI) to arraign Self-proclaimed National Resistant Movement general Miguna Miguna in court at 2 pm February 5. The judge said if Miguna is not availed, an explanation should be presented failure to which there will be punishment for contempt and defying court orders.

According to lawyer Peter Malinyani, Nairobi DCI boss Ireri Kamwende says he has no instructions regarding the opposition politician's release. This information reached Judge Kimaru as the DPP’s office admitted they were having difficulties getting instructions from police.

Miguna's lawyer Mr. Edwin Sifuna broke this news on his twitter handle. he posted, "High Court has ordered IG nad DCI to produce Miguna by 2pm or be cited for contempt."

Miguna Miguna was arrested at his Runda home, Nairobi on Friday over Tuesday’s ‘swearing-in’ of Raila Odinga as people’s president. Mr. Edwin SifunaHis lawyer Mr. Edwin Sifuna rushed to court to obtain orders directing that his client be released on Sh50,000 bond pending his arraignment in court on Monday. The order, however, was not obeyed and he spent the weekend in the cells.

The Director of Criminal Investigations (DCI) George Kinoti said that the vocal lawyer was apprehended for administering an illegal oath and being a member of NRM, a movement that has since been outlawed by the Government.

“Miguna publicly declared that he is the general of NRM, which is already declared a proscribed group. By the time he declared publicly, there was a gazette notice by the minister. How can we let it go? We are law enforcers,” said Kinoti.

Edwin Sifuna on Sunday then told social media followers that Miguna suffered an asthma attack at while in custody at Lari police station but the police denied access family and anyone else who went to see him.
