A Nakuru court has summoned Kapseret Member of Parliament Oscar Sudi after he failed to show up yesterday for a hearing in a case where he is charged with two counts of hate speech and one count of offensive conduct.
Daniel Karuri, the senior assistant Director of Public Prosecution, urged Senior Resident Magistrate Benjamin Limo to compel the lawmaker to attend court even as he sought for his arrest.
But Sudi's lawyer, Felix Orege, told Limo that his client was unwell and sought to have the hearing pushed to a later date.
Sudi, he added, would provide the court with a medical report during the next hearing.
The magistrate declined to issue an arrest warrant. "Instead, summons are hereby issued to the accused to attend court and avail medical documents in support of his disposition on the day he was to attend court," Limo ruled.

The prosecution had lined up three police officers from the National Cohesion and Integration Commission to testify.
The MP has denied that on September 7 last year, he used threatening words on social media, which were likely to stir up ethnic hatred. He is out on a Sh500,000 cash bail, with the trial slated to start on February 19.
