Nairobi businessman Brian Yongo has been served with a court order to vacate a house located in Kitisuru over alleged rent dispute.
The order follows a protracted legal battle in which the landlord, Dr Jigisha P Jani, claims Yongo, trading as Neptune Credit Management Ltd, has allegedly refused to vacate the rented house or pay rent arrears amounting to Sh3,168,850.
As per the court order dated June 18, 2015, the landlord sought to auction Yongo’s property to recover the outstanding money in rent arrears, which had accrued between April, 2010 and May, 2015.
According to a two-year tenancy agreement dated February 12, 2008, Yongo rented the house from Dr Jani and agreed to pay monthly rent of Sh150,000 for the first year and Sh165,000 monthly for the following year.
A court injunction document dated April 19, 2010 reveals that the High Court ordered, by consent, that the plaintiff (Yongo) pay a monthly rental of Sh181,500 until further orders of the court. It also ordered him to deposit Sh500,000 in court and withdrawn to the defendants. “Three hundred thousand shillings thereof being the undisputed two months rent arrears and the balance of two hundred thousand shillings to be applied as the new rent in adverse,” reads the injunction in part.
The property measuring 0.1958 hectares on Kitisuru Road, Nairobi, was initially registered as title number 5667, land Reference number 7741/269 (original number 7741/102/5) and delineated on land survey plan number (159263) under Alnashir Abdulkarim Chatur Popat. But ownership changed hands after the property was transferred to Ms Jigisha Pankat Jani and Mr Sailesh Jani, who are joint owners.
In an interview with The Nairobian in July 2013,Yongo, who is in the debt collection business, claimed he lived in a lavishly furnished 30-room house in Kitisuru, Nairobi. The residence has a gym, sauna, fully stocked bar, and a disco — complete with a smoke machine, DJ’s deck and lights.
“I use the underground disco to entertain my clients and visitors and I have all the fine whiskys at the bar,” Yongo told The Nairobian at the time. In his parking bay was a Range Rover Vogue and two Mercedes Benz S Class cars. Another ‘German machine,’ a Mercedes C350 luxury two-door coupe, that is said to change colour depending on the weather, was also parked at the residence.
Even though he is known to rub shoulders with the who-is-who in the political and corporate world, Yongo intimated that he had no interest in politics. “Why spend Sh60 million campaigning and then get paid a pitiable Sh500,000 as salary?” he had asked. “After all, I’m like an MP, since I’m a generous man. Every month, I spend about Sh500,000 helping people. And my monthly expenditure comes to around Sh3 million,” claimed Yongo.
