A supermarket attendant has told a city court that he was fired for not receiving calls from his boss’ wife.

Police said Bernard Juma Oyeyo was employed in 2002 before his employment was terminated years later.

He moved to court in 2013 to sue the director of Karia Supermarket in Nairobi, Mr John Kuria, citing unfair termination.

He wanted the courts to compel his former boss to pay him Sh1.6 million for unlawful dismissal.

Juma told the court that on the day he was fired, Kuria took away his mobile phone and ordered him to leave the shop without giving him any reason. He claims he was handed back the phone at 4pm and told to leave.

The complainant told the court that he was paid Sh48, 403 a month later.

Juma who had stepped out from his work station on the material day, told court that he was fired after he failed to pick a call from his boss’ wife.

The court however noted that the company had valid reason to fire Juma, but didn’t stick to employment rules.

In its ruling on November 23, the magistrate directed that: “Consequently, I enter judgement for the claimant total of Sh98, 999 as compensation for unfair termination and leave allowances for 2004 and 2007.”
