Suspended High Court judge Joseph Mutava

Suspended High Court Judge Joseph Mutava will defend himself against claims of gross misconduct tomorrow.

A tribunal investigating him yesterday adjourned after his lawyer Philip Nyachoti applied for the adjournment to travel to Eldoret for a court case in which the Turkana County Government officials are challenging their prosecution. The nine officials were accused of irregularly awarding contracts for road rehabilitation.

The prosecution had already exhausted its witnesses against the judge and tomorrow Justice Mutava will either defend himself, provide written submissions or call witnesses to defend him.

Mutava is accused of clearing businessman Kamlesh Pattni of charges in relation to the Goldenberg scandal, in which the country lost billions of shillings in dubious transactions.

He will also defend his orders reinstating the board of directors of East African Portland Cement. The entire board had been sent on compulsory leave pending investigations over a dubious Sh1 billion tender.
