Nairobi, Kenya: Sacked High Court Judge Justice Joyce Khaminwa has expressed her reservations over the neutrality of a five-judge Bench constituted to hear her case.
Khaminwa, through her lawyer John Khaminwa, told a three-judge bench that she was not comfortable with some judges appointed by the Chief Justice to hear matters filed by sacked judges.
Khaminwa made the submissions was objecting to a suggestion by Justice Weldon Korir to refer her case before Justices Isaac Lenaola, Mumbi Ngugi, Pauline Nyamweya, David Musyoka and George Odunga.
“I object to some of the judges in that panel to hear the application since some of them are committed to vetting,” said Khaminwa.

The case which is currently being heard by Justices Korir, Nyamweya and Odunga was adjourned until April 13 for further direction.
Korir had advised the judge to have her matter heard before the five-judge bench instead of the current three-judge bench.
Lawyer Khaminwa said he had no objection but changed his mind once he was given the names of the five judges.
