Head of Public Service Francis Muthaura will not present himself before CID officials for questioning in connection with the 2007 post-election violence.
Through his lawyer Karim Khan, Muthaura said he cannot face two jurisdictions in the investigations into the crimes he is alleged to have committed.
Khan told The Standard he had advised Muthaura against recording statements with police until after the confirmation hearings are through.

“It will be reckless and unfair for him to start dealing with eleventh-hour investigations being conducted by the police. Police can wait,” said Khan.
He said whereas his client was willing to face the police, he had advised him against the move adding that the ICC has the jurisdictions for the probe.
“We are not ready for police now. He can’t defend himself before two jurisdictions,” he noted.
He made the remarks following revelations that the CID had summoned all the six suspects, but only three have so far presented themselves.
The interrogation by the CID is part of the Government’s efforts to convince the ICC that it was capable of trying the Ocampo Six.
Many had been eager to see Muthaura, Deputy Prime Minister Uhuru Kenyatta and former commissioner of police Maj-Gen (rtd) Hussein Ali being grilled given their status in Government.
