The Environment and Lands Court in Nakuru will next Tuesday rule on a land case pitting the Ethics and Anti-corruption Commission, former Commissioner of Lands and two companies.
Justice Anthony Ombwayo will rule whether the 435-acre land in Naivasha, Nakuru County, is public land or it belongs to Pineapple Edge Limited and Trojan Nominees Limited.
The judge was absent and the ruling was deferred to Tuesday.
EACC has sued PEL, TNL and former Commissioner of Lands Wilson Gachanja over the alleged illegal acquisition.
The anti-graft agency claims the land is public and was set aside for Kenya Agricultural Livestock Research Organisation (Kalro) to use it as National Quarantine Station.
"The public land was irregularly allocated, registered and transferred to private companies," EACC alleges.
It accuses Gachanja of overseeing the illegal transfer of parcels to PEL and TNL on April 28, 1997, and December 6, 1997, respectively.
