A Kenyan living in the US has filed a Sh10 million suit against a private hospital over the death of his sister nine years ago.
Denis Moruri accuses Nyangena Hospital and Dr David Momanyi of being responsible for the death of Truphena Moruri who died on April 4, 2009 while undergoing caesarean section.
Moruri, who administers the estate of his late sister and takes care of her nine-year-old son, wants the court to compel the hospital to pay him damages for the loss of his sister who was a text books supplier.
He wants the facility compelled to pay upkeep for his nephew. Moturi is demanding Sh4 million for school fees, Sh2 million for food, Sh1.4 million for medical care, Sh1 million for shelter, Sh800,000 for clothing and Sh500,000 miscellaneous.
He says his sister, who was then aged 27, was eight months pregnant when she walked into the hospital for checkup but did not return alive. She died after a failed caesarean delivery.
"She left behind a boy who survived the failed operation presided over by Dr Momanyi at Nyangena Hospital. I have been taking care of the boy’s basic needs, but the responsibility is overwhelming given that I also have children to take care of,” he said.
He says the Medical Practitioners and Dentist Board, in a report dated November 13, 2012, found that Truphena died due to the defendants negligence.
