Kenya’s CID wants the International Criminal Court (ICC) to confirm if a man residing in the US is a witness in the Crimes Against Humanity cases facing four Kenyans.

Director of CID, Ndegwa Muhoro has written to the Attorney General, Githu Muigai to ask the global court to confirm if indeed Mr James Kabutu Maina is their witness.

Muhoro also wants AG’s office to facilitate an inquiry directed at the Office of the Prosecutor at the ICC regarding any official assignment that it may have given US based law professor Makau Mutua in relation to Mr Kabutu.

“Before we continue with our investigations we wish to have it confirmed that James Kabutu Maina is a witness of the ICC in the current proceedings against four Kenyan suspects.”

“In this regard, we are requesting your office to facilitate an inquiry directed at the ICC prosecution concerning this matter. Our investigations can only be conclusive if we have this confirmation,” reads part of a letter from Muhoro to Muigai.

The letter was written following investigations launched over claims Prof Mutua had tampered with the said witness also residing in the US.

The officers had in April summoned Prof Mutua and  former Kenya National Commission of Human Rights Chairman Maina Kiai for allegedly tampering with ICC witnesses.

Lawyer Paul Muite later recorded a statement on behalf of the two and denied that they had interfered with ICC witnesses.
