A man who sodomized a 31-year-old mentally challenged man appeared in a Nyeri Magistrates court on Tuesday.
Cyrus Ndung'u Theuri is accused of sodomising a 31 year old man whose state of mind is improper and who does not speak.
According to the prosecution, Ndung’u allegedly took advantage of victim's mental disability and inability to communicate and sexually abused him on August 26 last year.
The indecent act occurred at Giakanja Trading Centre and was reported to Giakanja Police Post by people who witnessed and who have also been lined up as prosecution witnesses.
The prosecution has four witnesses including the investigating police officer and the victim.

On Tuesday, the victim failed to testify before Principal Magistrate Philip Wambua owing to absence of the translator who is set to explain his testimony to the court.
The case was adjourned to September 27, 2016.
