Brian Mwenda set free on Sh200,000 cash bail

Brian Mwenda, a man charged with impersonation and forgery, has been set free on a cash bail of Sh200,0000 by a Nairobi court.

Milimani Chief Magistrate Lucas Onyina, while delivering his ruling, said he had considered submissions by both the prosecution and the defence and found there were no compelling reasons to deny the accused bail.

"I  agree with submissions made by defence lawyer Danstan Omari that there was no compelling reasons to deny the accused bail.I  therefore release the accused on a bond of Sh300,000 or alternatively on a  cash bail of Sh200,000 with one contact person",Onyina said.

The accused had been charged on Wednesday last week and detained at Industrial area prison.

Through his lawyers John Khaminwa and Danstan Omari, the accused had asked the court to release him on favourable bail.

Mwenda was on Wednesday charged with making a fake certificate for admission to practise law as an Advocate. He denied six counts including making a false document, uttering a false document and identity theft.

In an affidavit filed before the court,  Mwenda claimed that he campaigned for LSK president Erick Theuri  who is the complainant in the case when he (Theuri) was campaigning  for LSK president. Additionally, he claimed that Theuri bailed him out whenever he was arrested.

"Theuri has on numerous occasions used his powers as the law society of Kenya president to bail me ,Michieka and other friends from different police stations whenever we were arrested for drinking related issues," he stated in his affidavit. 

Mwenda has accused the LSK of overstepping its mandate arguing that it's a political season for the society. He adds that there exists cases of impersonation and the LSK leadership has never dealt with the said cases and participation the way they are dealing with him.

He says that there's evidence of his prowess and skills despite lack of formal training. 

On Thursday last week, the court allowed the Law Society(LSK) to be part of Mwenda’s case.

The case will be mentioned on November 7.
