The Environment and Lands Court in Nakuru has allowed a private developer to sue the National government over a parcel of land that was turned into a bus terminus.
In his ruling, Justice Mwangi Njoroge said the Director of Land Administration, the Director of Physical Planning, and the Attorney General must be sued too.
The land claimed by Lawrence Maina was used as a terminus since March 2020 during the Covid-19 pandemic. Maina then sued the Nakuru County government.
However, Nakuru Automobile House Limited filed a counterclaim, claiming ownership of the land.
Maina and the company produced titles for the land, in their names, forcing the county government to file an application for the three national agencies to be included in the case
Mr Njoroge allowed the application and ruled that the three government agencies must be involved in the case, for the court to make a sound judgment.
"It will be prudent to have all the necessary parties on board before the hearing of the case takes off," ruled Njoroge.
The judge noted that although Maina and the company claim ownership of the land, the county government insists the land is public and was set aside for the expansion of a public mortuary.
