Sacked county employee awarded Sh3.6m for wrongful dismissal

KAKAMEGA COUNTY: A sacked Executive officer has been awarded Sh3.6 million for wrongful dismissal.

Former Youth and Sports Executive Jamin Shitsukane had sued Governor Wycliffe Oparanya and his county for sacking him before his contract of service had expired.

He told the court that he was dismissed from service without following the due process as required by the law.

He added that he was never accorded a fair hearing before being sacked. Granting the Sh3.6 million damages, Judge Maureen Onyango declined to reinstate him or award him his full salary for what remained of his term in office. 

“It is my opinion that it will not be in public interest to order the return to office,” Justice Onyango ruled.
