Mungiki members to serve 10 years in jail for abduction, gang rape

Two men and a woman have been slapped with jail sentences of up to 10 years by a Kibera court after they were found guilty of abducting, assaulting and gang-raping a woman.

George Kimani Kamweru, Michael Njenga and Beth Nyambura were accused of wrongfully confining the victim in a house on August 7, 2013 jointly with others who escaped. In addition, the three, who were members of the outlawed Mungiki group, kept assaulting and torturing in a bid to extort Sh120,000 from the victim.

Separately, the two men with others not before court, raped the woman on August 8, 2013. They were also accused of touching the woman’s bottoms and bosom with their private parts.

The woman told the court that she had borrowed some money from a creditor but failed to repay on time and that on the day she was abducted, she had gone to see the creditor for rescheduling of payment.

She met with Nyambura, who lured her into a car where she met other accused person and she was then abducted.

“One of the accused persons assaulted me with shoes on my head, electric cable and a rungu while the other strangled me, kicked me, and hit my jaw with the fist till I lost consciousness,” she told the court.

“They tore my clothes when I hesitated to undress following their order. At some point, they asked me to remove my clothes to avoid tearing them so that they could rape me,” she said.

The two men were arrested after her brother asked them to go and pick the money.

While sentencing them Senior Principal Magistrate Philip Mutua noted that the prosecution had proved its case beyond any reasonable doubt. In mitigation, the suspects asked for leniency, stating they were first offenders. They were slapped with three years in jail for assault, five years for kidnapping, and 10 years for Njenga and Kamweru for raping her.
