Reports that the complainant in an attempted murder case against the widow of former Cabinet minister Mbiyu Koinange is dead are false.

Mr Joseph Mpoe and his family said they were shocked to read on social media that he was dead.

The reports came after a judgement by the Court of Appeal following an appeal before a Nakuru court by Eddah Wanjiru Mbiyu and six others who sought to stop their prosecution over the murder of Moses Ole Mpoe and Parsaaiya Ole Kitu on December 3, 2010, at Soilo junction along the Nakuru-Kisumu highway.

The attack was said to have been carried out by gunmen riding on a motorcycle. They reportedly shot at a motor vehicle killing two passengers and seriously injuring one passenger - Joseph.

Joseph and his son have come out to question the origin of the information that he is dead.

"I saw reports on social media that I, Joseph, died while the case was going on. I was shocked," he said adding that he fears for his life as he demanded evidence that he died.

His brother Josphat Ole Mpoe said the matter should be investigated.

"Those who claimed he is dead should be investigated and made to produce evidence to back their claims."

Josphat Tuesday added: "As a family, we would like to know the person who said Joseph died. Let that person provide us with the burial permit and death certificate. The person should also show us where he was buried. However, all we know is that Joseph is here. He is alive."
