Football Kenya Federation gets reprieve after Tribunal ruling

Sports Tribunal ruled yesterday that Football Kenya Federation administration can continue with its operations, despite its failure to comply with the Sports Act.

The federation will, however, pay a Sh500,000 fine by April 15 and report to the tribunal four days later on the steps they have taken to comply.

While delivering his ruling, tribunal chairman John Ohaga said while the federation may have been wrong in not complying, taking away their mandate to run football in the country was not the right way to deal with the matter.

“We must consider the fact that FKF is affiliated to Caf and Fifa and thereby, have to adhere to their rules,” read part of the ruling.

FKF lawyer Ken Ochieng said he is delighted with the ruling and said they have already made steps to comply with the Sports Act.

“We are happy the tribunal made the right decision and on our part, promise to comply with their demands,” he said.

The tribunal’s ruling had threatened to end the tenure of the newly elected FKF office after a case was filed challenging the legality of the federation as it had not complied with the Act.

According to the Act, all sports federations had an August 2014 deadline to comply with it. But former FKF officials led by Sam Nyamweya did not institute the transition, arguing the federation was registered under the Registrar of Societies.

Meanwhile, Gor Mahia chairman Ambrose Rachier has rubbished a notice calling for the club’s Annual General Meeting.

According to Rachier, the notice “is fake and is engineered by an imposter with no authority to make the call on behalf of the club.”

While dismissing the notice, Rachier said the club’s Executive Committee will call for the AGM through the right channels.

In an earlier statement, the chairman said the club’s elections can only be held after the regular season runs out, picking on the November – December 2016 period for the polls.

“The attention of Gor Mahia Football Club management has been drawn to a “notice” on the club’s official letter headed paper dated Sunday, March 13, 2016. The said “notice” claims to be calling for an Annual General Meeting (AGM) with elections as an item on the Agenda.
