Police recommend charges against FKF boss on conspiracy to defraud over Harambee Stars trip

The Directorate of Criminal Investigations has recommended fraud charges be preferred against Football Kenya Federation (FKF) President Sam Nyamweya.

If Director of Public Prosecutions (DPP) Keriako Tobiko agrees with the recommendations from the police investigations, the FKF president is expected to be charged alongside FKF Secretary General Michael Esakwa and Acting Finance Manager Samson Cherop.
In a statement, Mr Tobiko said he will review Nyamweya’s file and thereafter render a decision based on the evidence presented and the law.

In the recommendations, the police want all the three suspects to be charged with conspiracy to defraud, stealing by agent and fraudulent false accounting.

The statement reads: “CCID Nairobi Area Inquiry File No. 19/2015- Inquiry into how funds amounting to Sh17,241,824 was utilised by Football Kenya Federation in nearly abortive trip by Harambee Stars to Cape Verde.”

Nyamweya’s woes hit the limelight when he was named by President Uhuru Kenyatta in the list of shame compiled by the Ethics and Anti-Corruption Commission (EACC).

However, the adamant Nyamweya did not step aside as directed by the President, maintaining that he is innocent.

Nyamweya, who was elected to the FKF office in 2011, was this year accused of misappropriating close to Sh50 million (USD 500,000) from the world football governing body, Fédération International de Football Association (Fifa); money which was meant for development aid in the sport.

According to a German television expose, bank statements did reveal over Sh20 million (USD 200,000), which came from Fifa, was not reflected in the FKF annual report. However, withdrawals adding up to Sh50 million did pop up after the deposits, the German TV claims.

In November, Nyamweya presented himself at the Criminal Investigation Department (CID) to record a statement regarding Sh17 million released by the Government to facilitate national team Harambee Stars World Cup qualifiers match against Cape Verde.

This led to a stand-off between FKF and Harambee Stars players who refused to depart for Cape Verde until their full allowances were paid, with international players demanding a refund of their air tickets.
