KRA defends new tax on fuel, wants suit challenging it dismissed

The Kenya Revenue Authority (KRA) has defended the 16 per cent value added tax on petroleum products.

Through lawyer Kenneth Kirugi, KRA said it did nothing wrong by implementing what was passed by the National Assembly and that the case by activist Okiya Omtatah challenging the new tax was baseless.

“The case is frivolous, without any merit and an abuse of the court process.

The court cannot assume executive powers to overturn what went through legislation in Parliament before it became operational,” said Mr Kirugi.

He added that said the Government could only be faulted if it did not involve Parliament in passing the resolution.
