Police list Devolution CS Anne Waiguru as prosecution witness in Sh791m NYS scandal

Kenya: Police now want Devolution Cabinet Secretary Anne Waiguru to be a prosecution witness in the National Youth Service (NYS) Sh791 million scandal.

The team of detectives from the Banking Fraud Investigations Unit resubmitted their file to the Director of Public Prosecutions Keriako Tobiko listing Waiguru as a witness.

The officers said after recording the CS’s statement, they concluded she will be a prosecution witness.

Tobiko confirmed that CID sent the file to his office on Friday listing the Waiguru as a witness and promised to make a decision soon.

“The file was resubmitted to this office and it’s true the CS is listed as a prosecution witness. We will look at the recommendations and evidence therein before making a decision,” said Tobiko.

He said he is also waiting for another file from the Ethics and Anti- Corruption Commission (EACC)  and Kenya Revenue Authority (KRA), who are also independently investigating the matter.

“Police were investigating aspects in the Penal Code, while EACC and KRA are pursuing other angles. It is the same matter but different aspects,” said Tobiko.

Tobiko had sent the file back to the investigating agencies in September after initial probe by the CID proved in-actionable.

While sending back the file to the CID, Tobiko said it was important that the CS records a statement.

The CS was grilled in her office by the officers, where she recorded her statement.

Tobiko said several aspects of fraud raised in the file fell under the mandate of the EACC.

It was then that he also sent a copy to the KRA for action. KRA have also contacted the CS and other officials mentioned.

On Tuesday, Waiguru was grilled at the EACC before her lawyer Ahmedinassir Abdullahi announced that she was a prosecution witness. She was questioned for eight hours.

Officials at the EACC said they sent the file to the DPP Wednesday, also listing her as a witness.

When she went to the EACC, she told the officials she was the one who blew the whistle on the fraud and she was ready to be their witness.

Planning Principal Secretary Peter Mang’iti is among those who have also been grilled by EACC.

The agencies are investigating the loss of the Sh791 million and conspiracy to steal Sh695 million.
