Former Philips CEO complains of assault from his estranged wife

Former chairman of Philips Electronics East Africa has written a letter to the Director of Public Prosecutions (DPP) seeking investigations into the conduct of Gigiri OCPD Richard Mugwai.

Tob Cohen says that Mugwai is collaborating with his estranged wife Sarah Wairimu to corrupt and strain the streams of justice.

Cohen though Musyoki Mogaka advocates say that Wairimu who has been assaulting him failed to honor summons by the Parklands Police Station OCS.

The man is seeking justice over continuous harassment and denial of his conjugal rights by Wairimu over ownership of properties.

Cohen has written a letter directed to the Director of Public Prosecutions (DPP) Noordin Haji and Inspector General of police over an attempted abuse of criminal justice system by Wairimu.

“Unless your offices act speedily and accordingly, our client will continue to suffer humiliation, discrimination and persecution because he is not a Kenyan National, which is wrong, distasteful and unfortunate,” said Cohen through Musyoki Mogaka and Co advocates.

In a letter dated July 12, 2019,the 69 years old Dutch National and a businessman living in Kenya since 1987, claims that Wairimu is determined to abuse the criminal justice by colluding with officers from Parklands Police Station to prosecute him over assault.

“My client is astonished at the manner in which the law is being applied to his disadvantage since no step has been taken by police officer at Parklands Police Station to prosecute Wairimu despite enough evidence demonstrating her guilt,” said Mogaka Musyoki advocates.

“On February 5, 2019 Sarah Wairimu Kamotho stormed in our client’s home office, and threw a glass of water aimed at the face of our client and threatened him,” said the law firm.

He added that on February 8, 2019 Cohen buried the hatchet and decided to let bygones be bygones after Wairimu approached him and offered him whisky.

“Around midnight, as he was standing on top of the stairs leading to the garden, Sarah suddenly pushed him down stairs, causing our client to fall and seriously injure his forehead,” said the law firm.

It is said that while he was lying helplessly on the floor bleeding profusely, Wairimu pounced on him and pushed his head against the ground and kicked him.

Omari said that on February 10, 2019 when he regained strength, Cohen went to MP SHAH Hospital and was thoroughly checked and a report compiled.

“On  February 13,2019 upon the advice of his then counsel, our client made a report to the Parklands Police Station and obtained a P3 form, which was painstakingly filled by the police doctor,” said Mogaka Musyoki and Company advocates.

The devastated man said that there has been a plan to have him prosecuted for allegedly assaulting Wairimu. He says this plan is intended not only to ruin his reputation but also have him deported from Kenya so that his properties are left with Wairimu.

Lawyer Omari in the documents, has stated that the two experienced deep misunderstanding due to ownership of the said property to an extend that Wairimu denied his client conjugal rights.

He added that Wairimu has even taught her daughter to be disrespectful to Cohen whether in public or within the family set up.

“Despite the incentive to have our client provoked, he has all along been calm and harmless due to his commitment to the laws of Kenya, and his pride as a Dutch patriot that respects women and international relationships,” said the law firm.

The man added that due to the never ending hostility by Wairimu, he instructed the firm of Judy Thongori & Co.Advocates who briskly commenced divorce proceedings on his behalf under a certificate of urgency in the now DIVORCE CAUSE NO.35 OF 2019.
