The National Super Alliance has asked the Supreme Court to choose between standing with Kenyans to defend the Constitution or leave them at the mercy of those who trample their rights.

The coalition further revisited the brutal killing of Independent Electoral and Boundaries Commission ICT manager, Chris Msando, by playing a video clip in court to demonstrate his death was linked to alleged hacking of the commission’s electronic systems.

Lawyer Anthony Oluoch said Mr Msando’s death just a few days to the election raised questions about the credibility of the IEBC systems and wondered why James Muhati was reinstated despite issues of integrity.

Unclear circumstances

“Mr Muhati was suspended and Msando took over but he (Muhati) returned under unclear circumstances a few days before the killing. Our analysis confirms there were two parallel systems playing out at IEBC,” said Mr Oluoch.

The video clip played in court captured Msando assuring the public that the IEBC election systems were secure and that nobody could interfere with them under his watch.

NASA’s other lawyer Mutakha Kangu dwelled on the constitutionality and legality of the presidential results declared by the commission, and whether the election met the threshold set by the Constitution.
