Reprieve for five MCAs kicked off assembly committees

A court has temporarily reinstated five MCAs who had been ejected from various committees.

James Mutugi of Wamumu Ward, John Namu (Mutithi), John Nyaga (Kanyekiini), Jackson Murimi (Thiba) and their nominated colleague George Kagori had gone to court seeking orders to have the decision to have them removed reversed.

Kerugoya High Court judge Robert Limo ordered the MCAs to be allowed to serve in the respective committees until the matter was heard and determined.

Their application dated July 25 was certified as urgent by the court, which also granted them leave to challenge their removal from the committees.

Named in the application was the Kirinyaga County Assembly as the first respondent and Assembly Majority Leader Kinyua wa Wangui as the second respondent.

While issuing the orders, Mr Limo told the applicants to file a constitutional petition within 21 days clearly outlining which of their rights had been violated by their removal. A hearing date will be set after this.

It was claimed that the five were working against the county government hence their removal. Following the court order, the MCAs will continue drawing sitting allowances until the matter is heard and determined.
