ICC Prosecutor Fatou Bensouda is ungrateful, says AG Githu Muigai

NAIROBI: Attorney General Githu Muigai has criticised International Criminal Court  Prosecutor Fatou Bensouda for failing to acknowledge help from the Government.

Prof Muigai criticised Ms Bensouda for citing lack of co-operation from Kenyan authorities for the collapse of cases against Deputy President William Ruto and journalist Joshua Sang'.

Muigai alleged that Bensouda never acknowledged publicly the catalogue of sustained legal co-operation and assistance provided by Kenya.

This, he said, was apart from him availing oral submissions three times, making him to be the only AG to have appeared before the court.

"The Prosecutor has never sought to inform the public through Office of the Prosecutor (OTP), press releases, or through the Assembly of States Parties (ASP) or civil society briefings that her pertinent actions and operations in the Kenyan situations had been undertaken as a result of the co-operation of the Republic of Kenya," said Muigai in a statement.

Muigai noted it is only once that the Prosecutor and her staff privately confessed of how the Kenyan police were helpful in search of prosecution witnesses.

"It is unfortunate that Bensouda is so tight-lipped publicly about this extraordinary assistance, details of which she and her office are well aware of. The immense time and resources expended remains unmentioned instead, there is a deliberate and concerted attempt to deceive the international community of non-cooperation," said Muigai.

Kenya, he said, had submitted unedited, complete National Security Advisory Committee minutes to the ICC.
