KISUMU, KENYA: Law Society of Kenya (LSK) is in the process of organising a forum to discuss the decision of the Supreme Court on the presidential election petition.
Chairman Erick Mutua says they will critique the judgment and give their official position on it. Mutua urged the Judiciary to welcome positive criticism saying: “Critiquing an office does not mean you don’t respect it.”
He urged the top court to take responsibility for errors made on its judgment to enhance confidence in the institution. He, however, did not state when the forum would be held.
“Although the amendments to the judgment were minor, we don’t expect a verdict of such magnitude to have the errors. Whoever wrote or read the judgment ought to have been keener,” Mutua said.
Last week, the court moved to correct errors in its judgment dismissing the petition by former Prime Minister Raila Odinga that challenged President Uhuru Kenyatta’s election.
The errors included quoting wrong clauses in the Constitution and even wrong dates.
Speaking in Kisumu during a legal education on the new land laws yesterday, the LSK chair feared that it will be difficult to implement the TJRC report because it implicated senior Government officials.
“The report is likely to be rejected in the National Assembly because it may lack the goodwill of some MPs,” he said.
