Kenya: The parents of a student shot dead by flying squad officers 15 years ago are yet to be compensated despite a court order.

James Ocholla Odhiambo also known as Jordan, who was a student of United States International University, was shot dead on July 27, 1998 after being mistaken to be a car jacker.

The couple, Prof Peter Odhiambo and Mrs Peninah Ochola filed a suit against the Government, which was heard and determined last year. Judgement was entered in their favour for Sh10 million plus costs and interest.

But they have been unable to get the money from the Government.

They have sued the Office of the President for failing to abide by an order from the High Court in Nairobi.

Prof Odhiambo, and his wife have filed a judicial review application asking the court to compel the Principal Secretary at the Office of the President to release the money.

The case has been certified as urgent and the couple allowed to seek orders against the Attorney General (AG) and the Principal Secretary, Office of the President.

The couple says they have filed for recovery of Sh10 million being special damages arising from a fatal accident because the court order had not been honoured.

“The deceased’s 15th anniversary is on July 27, 2013 and the applicants wish the matter be finalised and settled by then,” says Prof Odhiambo in his affidavit.

The couple says they have no other way of executing the order except by moving to court again to get a court order to compell the PS, office of the President to release the money.

The parents have written to the AG several times requesting payment but it has not been forthcoming.

The latest letter by the couple through their lawyer Betty Rashid was written to the AG on April 25 seeking payment.

The couple sought compensation following the conviction of three police officers by the High Court.

The three officers were sentenced to life imprisonment for manslaughter.

The officers, Isaiah Muoki, Kenneth Obiero and Andrew Koross, of the Pangani-based Flying Squad were charged with murder of the fourth year Business Administration student at United Stated International University on July 27, and 28, 1998 as he drove along Kenyatta Avenue.

 In mitigatiojn, the three flying squad officers argued they shot at Mr Odhiambo on suspicion he was a carjacker. He was driving home from United States International University’s Nairobi campus.
