The Government has filed documents in support of an application to have the ‘Ocampo Six’ tried locally.
Lawyers representing the State filed more than 30 documents in a bid to convince the International Criminal Court to refer cases back home.
They include reports from the police on post-election violence investigation, support from the US government for reform and restructuring of the Department of Public Prosecution in Kenya and the United Nations Office on Drugs and Crime report.
The lawyers — Sir Geoffrey Nice QC and Rodney Dickson will also rely on the Judicial Service Act 2011, Vetting of Judges and Magistrates Act 2011, Witness Protection Amendment Act 2010 and the Constitution to support their case.
The lawyers said there have been further developments in respect of national investigations, including those touching on Eldoret North MP William Ruto, Finance Minister Uhuru Kenyatta, Tinderet MP Henry Kosgey, Civil Service boss Francis Muthaura, Postmaster General Hussein Ali and radio presenter Joshua Sang.
Police probe
The cases are being investigated by the police, including bi-monthly reports submitted to Attorney General Amos Wako.
"The instruction confirms all cases, including the two cases before the ICC, are being investigated expeditiously and that progress reports will be available for submission to the Pre-Trial Chamber as indicated in the application," said Nice.
The list was filed the same day ICC Prosecutor Luis Moreno-Ocampo filed a document asking the court to allow the Government to respond to issues raised in its application to have the six suspects prosecuted locally.
Ocampo said his office was not opposed to response to the issues, since this was the first time the ICC was considering a challenge brought by the Government on admissibility.
The prosecutor said parties in the case might raise issues that the State did not raise in its application on admissibility filed on March 31.
Ocampo said once the Government responds to the issues raised by other parties, the Chamber should not allow any other request to rep ly.
