MP sued for allegedly holding two public offices

Kabete, Kenya: Kabete Member of Parliament (MP) George Muchai has been sued for allegedly holding more than one public office contrary to the Constitution.

Activist Charles Omanga in a suit filed yesterday at the High Court claims Muchai has violated the Election Act by holding more than two offices at the same time.

“By holding more than one public office, Muchai is acting contrary to Leadership and integrity Act,” he said. 

Omanga claims the MP has been drawing benefits in contravention to Chapter six of the Constitution and the Leadership and Integrity Act.

He wants the court to restrain Muchai from being a board member of the Independent Electoral and Boundaries Commission (IEBC) pending the hearing and determination of the case.

Before his election as MP, it is alleged he was appointed to represent the Central Organisation of Trade Union (Cotu) on the National Industrial Training Authority (Nita) board which is a State corporation.

It is said he was appointed the vice-chairman of the Nita board and has served in that position to date. He is said to have continued to serve on the board even after his election as MP.

Muchai is therefore accused of holding more than one public offices and unlawfully draining benefits contrary to the law.
