A man has been sentenced to six months community service for stealing and slaughtering a cousin’s goat claiming it was tethered on a common boundary.
Alfred Osugo appeared before Ogembo Senior Resident Magistrate Lily Nafula and pleaded guilty of stock theft.
On October 16, the complainant tethered his goats on a grazing field at Nyaramba, Gucha South District. But in the evening, he discovered one was missing.
He reported the matter to the clan elder and a search led to the accused’s house where they found he had already slaughtered it and was preparing a meal.
In mitigation, Osugo argued that the goats had strayed into his farm and destroyed crops.
Osugo claimed he accidentally killed one goat with a stone and slaughtered it out of fear.
In his social valuation report, probation officer B.M Okumu recommended a non-custodial sentence saying the accused was remorseful.

A 78-year-old man who speared a 17-year-old boy will serve five years for manslaughter.
Sylvanus Odongo Opudo of Kawere, Homabay District killed Samson Omondi Ojwang’ on October 3.
The old man pleaded guilty before Senior Resident Magistrate Charles Mutai. Odongo said he found Samson near his sugarcane plantation and suspected he was planning to steal sugarcane.
"I knew he was going to steal like many others have been doing. I had to spear him," he said.
The court heard that the accused, after spotting the boy near his shamba, hid in a thicket and threw the spear, killing the boy instantly. The villagers wanted to lynch him but the area chief called the police who rescued him.
A probation report showed that residents were very bitter and wanted to kill Odongo if he was set free. Before killing the boy, he had been seen carrying a spear, walking across the village telling people that he would soon kill. Villagers also accused him of strangling a goat to death. They claim he is being haunted by spirits of a person he killed when he was a watchman.
His family members have been chased from the village.
Husband in trouble for beating wife
A middle-aged man has pleaded guilty of attempting to assault his wife.
Appearing before Thika Senior Principal Magistrate, Ms M R Gitonga, John Waema Mwanzia also admitted threatening to kill Mary Mutheu Waema using a panga.
On November 5, Mwanzia went home at around 8pm and started quarrelling with her. The wife later sought refuge at a neighbour’s house after he became violent.
The following night, Mwanzia was still angry and threatened to kill Mutheu prompting her to report the matter to police.
In mitigation, Mwanzia said he was angry after the woman sold their goat without his approval.
"She had requested for money to give to her mother who wanted to visit a relative at Thika District Hospital. I planned to sell charcoal to raise the money but I was surprised to find she had sold our goat for only Sh600," said Mwanzia pleading for forgiveness.
He was put on probation until November 18, when the magistrate will deliver the ruling.
