A minister has sued the Ministry of Lands for issuing a second title deed on his plot.
Education Minister Sam Ongeri has sued the ministry and a private company over a beach plot he says was allocated to him in 1994.
Prof Ongeri alleges the Registrar of Lands fraudulently issued a second title deed to an Italian-owned company called Greenbay Holding.
Yesterday, Ongeri testified before Malindi Resident Judge Hellen Omondi, and showed a letter he got from former President Moi authorising the land be allocated to him.
He spent more than one hour testifying how he was allocated the 0.8247 hectares beach plot in Kilifi.
He has also sued Greenbay Holding Ltd, which claims the plot and blames the Registrar of Lands for issuing another title deed on the same piece of land.
He told the court how he saw the land in 1990, and wrote to the former President requesting the idle plot.
Ongeri said he then processed all documents and was issued with a title deed in 1994. Later, a friend told him his plot had been allocated to the foreign company and issued with another title deed on January 15, 2003.
The minister asked the court to nullify the second title, saying documents at the Land Ministry indicate he was the legal owner.
"My lord, I pray the second title to Greenbay Ltd be nullified and I be declared the legal owner of the beach plot," he pleaded.
The hearing was adjourned until October 23 and November 6, when more witness are expected to testify.
