The stand-off in the Committee of Experts continues with one member, Ms Njoki Ndung’u vowing to stay away until her concerns are addressed.
Yesterday, Ms Ndung’u accused some of her colleagues of participating in an illegality by going ahead and compiling a draft of a constitution in disregard of laid down procedures.
"I am still staying away from the committee and its activities. They are engaging in an illegality of which I don’t want to be party to," she said, even as she maintained she was a member of the CoE.
"All I am asking for is we halt the drafting of the constitution until we get views on all matters including those identified as contentious. We should give room to all Kenyans to participate, but not lock some out merely because we are racing against time," she added.
But CoE Chairman Nzamba Kitonga told Njoki to "either take the explanation as contained in a letter or simply shut up".
Endless letters
"I am not going to engage in endless exchange of letters with Njoki. She either joins us or leaves us alone. We are not doing anything out of our mandate. We are within the law and we have deadline to beat," he said.
He said the drafting was progressing well.
Njoki has boycotted CoE meetings for nearly a month. She first complained in writing that a plan to go for a retreat in Naivasha to work out a draft based on issues agreed upon so far was unprocedural.
She asked the committee to slow down and give room to other stakeholders to give their views.
In his reply, Mr Kitonga said they were running out of time.
But yesterday, Njoki rubbished the response, saying the chairman avoided addressing "more serious issues I raised and for that matter I am not joining them in their drafting business now".
She said she was waiting for a response from the Parliamentary Committee on Constitutional matters.
