DPP Keriako Tobiko orders review of graft claims on NSSF Acting Managing Trustee Richard Lang'at

Director of Public Prosecutions (DPP) Keriako Tobiko has ordered a fresh review of the Sh5 billion graft claims against National Social Security Fund (NSSF) Acting Managing Trustee Richard Lang'at.

Mr Tobiko ordered the Ethics and Anti-Corruption Commission (EACC) to fill gaps identified in a probe file sent to his office before resubmitting it.

"Having independently reviewed the file, I have noted a number of critical gaps and omissions in the evidence and investigations, which must be addressed before I can make a conclusive decision. I have, therefore, returned the file for the aforementioned areas to be addressed and the file re-submitted for my appropriate directions," said Tobiko.

The EACC had recommended administrative action against Mr Lang'at after it concluded there was no criminal culpability against the him and the board.

The commission was investigating Lang'at and other NSSF Board of Trustees members over irregular approval of Sh5 billion for the regularisation of Tassia II Housing Project and the subsequent award of the lucrative tender to China Jiangxi International Kenya Ltd.

Separately, the DPP absolved Isiolo Governor Godana Doyo and his County Secretary Ibrahim Wako of any criminal offense.

The two had been accused of manipulating county payroll through employment of casual labourers.

EACC had recommended that Mr Wako be charged over the issue. But Tobiko said there was no laid down procedures for hiring of casual workers by county government.

"Further, the issue of employment of the casual workers was addressed and resolved in a meeting dated December 10, 2014 held between County Public Service Board and the chief officers," said Tobiko.

The cases are among those listed in the list of shame that was presented to Parliament by President Uhuru Kenyatta.

A bulk of the files on the 175 cases remain in the hands of EACC. Of these, the EACC detectives have grilled five Cabinet Secretaries, four Principle Secretaries, two senators, 12 governors, and 11 other senior government officials who include heads of parastatals.

The Cabinet secretaries include Kambi Kazungu (Labour), Charity Ngilu (Lands), Felix Koskei (Agriculture), Michael Kamau (Infrastructure) and Energy's Davis Chirchir.

EACC is questioning at least 55 National Assembly MPs belonging to the Public Accounts Committee and Agriculture committee over corruption claims.
