Former Judiciary Chief Registrar Gladys Shollei seeks anticipatory bail

Gladys Shollei, the former Judiciary chief registrar, will this morning appear before a Nairobi court seeking anticipatory bail.

Through an urgent application, Ms Shollei is asking for bail in anticipation of a possible arrest after she was adversely mentioned in a corruption report submitted to the National Assembly and Senate by President Uhuru Kenyatta.

She said recent actions by the Ethics and Anti-Corruption Commission (EACC) are a threat to her constitutional rights against arbitrary arrest.

Through lawyer Edwin Sifuna, the former Judiciary registrar stated in documents filed at the court's registry that EACC had repeatedly refused to tell her whether it was investigating her.

"EACC has repeatedly refused to confirm to the applicant (Shollei) whether it was conducting any investigations against her only to list her as among the people it was investigating in its report dated March 20, 2015, tabled in Parliament by the President," she says.

She claimed EACC intended to ambush her and arraign her in court on bogus charges to publicly harass, humiliate and disparage her.

Shollei was dismissed from her position in the Judiciary following several allegations, including financial mismanagement, against her.

"I have been subjected to untold mental and psychological anguish and torture, and hounded by repeated reports in the local media that I am being investigated by EACC for a host of unspecified crimes committed during the tenure as chief registrar," she stated.

She said the anti-corruption commission had not asked her to record a statement or notified her of any ongoing investigations against her.

Shollei said she wrote to the commission to seek confirmation on the said investigations, but EACC had refused to disclose any information.
