A male teacher found himself in a Vihiga law court for allegedly spending the night with a 20-year-old student in lodging in Chavakali.

Elisha Kedode, who was the deputy principal at Mbihi Secondary School, allegedly committed the offence in 2014.

The court heard that the girl’s parents, acting on a tip off from a neighbour, followed the teacher to the school. The teacher allegedly escaped through the fence.

The school’s Board of Management interdicted Kedode on October 2014.

The interdiction however drew criticism, with Kenya National Union of Teachers (Knut) Vihiga Branch moving to the Industrial Court to challenge Kedode’s interdiction.

In the verifying affidavit, Dick Kisivuli Atsiaya, the Knut Executive Secretary for the region, said the decision by the TSC to interdict the teacher was based on hearsay.

TSC claimed the decision by Knut to go to court would compromise teachers’ integrity in the region.

“In the case of the Mbihi teacher, there was enough evidence the teacher had spent the night in lodging with his student. He even confirmed it himself. We don’t know what the intention of the teachers’ union was when they decided to go to court to contest his interdiction,” TSC Director Mr Francis Ngware said.

Ngware said cases of teachers having sex with their students had reduced after a few teachers were interdicted in 2014. He however warned the vice could resurface if the union begins moving to court to block interdiction of culprits.

The student who has since completed her studies in the school is expected to act as the complainant.

Senior Resident Magistrate Grace Mmasi released Kedode on Sh 100,000 bond.
