Petition to swear in DP William Ruto as President to be withdrawn

 

NAKURU, KENYA:  Petition filed two weeks ago by a young lawyer asking Chief Justice Willy Mutunga to swear in Deputy President William Ruto as president could be withdrawn on Wednesday 22.

Felix Kiprono Matagei has asked Nakuru based Lawyer Kipkoech Ngetich to withdraw the petition.

The Standard Newspaper accessed a copy of elecctronic mail from Kiprono to Ngetich asking him to 'kindly withdraw or do anything deemed fit'.

He however, emphasised for the withdrawal of the case he filed as a private citizen saying it has been overtaken by events. High Court judge Isaac Lenaola sitting at Milimani Court in Nairobi had scheduled the mention for Wednesday 22.

"Kindly inform the court that the reasons why I did not turn up for the hearing on October 9 was because my life is in danger and I was earlier kidnapped which I reported to KICC police Station," reads the communication to his lawyer.

Ngetich confirmed he will withdraw the petition on Wednesday. "The petition was frustrated by state agents and the boy only wanted to set jurisprudence for the court to interpret," Ngetich said.

The young city lawyer had alleged that Uhuru resigned before heading to The Hague for his ICC status conference.
