Bahati MP,Kimani Ngujiri spends night in cell for assaulting a policewoman

Bahati Member of Parliament (MP) Kimani Ngunjiri has been charged in a Nakuru court with six counts related to an incident where he assaulted a traffic policewoman.

Resident Magistrate Rita Amwayi, however, remanded the legislator in police custody for a day after the prosecution said the investigation had not been completed.

The MP faced two separate charges after he allegedly assaulted police officer Maria Mutheo while she was on official duty in Nakuru town on Thursday evening.

In the first set of three counts, Ngunjiri denied obstructing a police officer while in her due execution of police duties on August 15.

He also denied resisting arrest contrary to section 103 (a) of the National Police Service Act 2011. The third count stated that on the same day he assaulted the same police officer.  The MP faces other three traffic offences including failing to observe traffic rules, failure to observe verbal instructions by the said officer and driving a defective motor vehicle.  He denied all the counts. His lawyer David Mongeri applied for the court to release his client on bond saying the accused is an MP and other terms might not be favourable to him due to his nature of work. He said the MP was ready to comply with terms set by the court and will avail himself any time he is required by the court.

The court objected to an application by the lawyer to have the police issue the legislator with a P3 form, saying the documents he presented before the court were mere receipts and not medical reports.

Independent investigation

The court rejected Mr Monegeri’s request for an independent police unit to investigate the circumstances that led to his clients’ arrest. “c and police to take necessary step or rather investigated with officers outside Nakuru station,” said Mongeri.

Prosecutor Gerald Nyongesa said the police required a day to complete investigations and they feared the accused if released on bond might interfere with investigations. The court placed the bail at Sh500,000 with same surety of a similar amount or alternative of cash bail of Sh100,000 for the first three counts.

On the second set of three traffic related counts, the magistrate set the bail at Sh100, 000 with surety, alternatively cash bail of Sh50,000. Hearing of the first three counts is scheduled on October 21 while hearing of the other three counts on October 4.
